Terms & Conditions
1 - Introduction
1.1 Totem Training Ltd agrees to provide, and the customer agrees to undertake and pay for the training courses and/or services supplied under this agreement.
1.2 All charges quoted by Totem Training Ltd are valid for a period of 60 days from the original proposal, unless stated otherwise.
2 - Cancellation
2.1 If the customer wishes to cancel, the following charges will be incurred:
- Up to 6 weeks prior to course commencement date – 25% of total cost Up to 4 weeks prior to course commencement date – 50% of total cost
- Up to 2 weeks prior to course commencement date – 75% of total cost
- Inside of 48 hours – 100% of total cost
Change to an alternative date 4 weeks prior to course commencement date - £50 adjustment fee.
Change to an alternative date within 4 weeks of course commencement date - £100 adjustment fee.
2.2 If a customer cancels tailored training for any reason up to 6 weeks prior to a scheduled course commencement date then all development work undertaken up to that point plus a cancellation charge as applicable in 2.1 will become immediately due for payment.
3 - Payment
3.1 Standard payment terms are 14 days from the date of invoice, unless written agreement prior to provision of services has confirmed otherwise.
3.2 If a customer fails to make payment on the due date Totem Training Ltd reserves the right to levy a late payment charge at 1% over Barclays base lending rate. Charges to be calculated from the due date to the date the cleared funds are received by Totem Training Ltd.
4 - Confidentiality
4.1 Totem Training Ltd will treat all information relating to the Client in the strictest confidence and will not divulge or share any information with any third party without the Client’s expressed written permission.
5 - Copyright
5.1 The copyright and all other intellectual property rights in all courses developed for customers shall remain the sole and exclusive property of Totem Training Ltd. The customer undertakes that it will not copy or permit the copying of course materials, nor disclose or permit disclosure or sell or hire the same to third parties, nor use the same for running the customer’s own courses unless the express written permission of Totem Training Ltd is given.
